VELOGUIDE INC., through its parent, subsidiaries and corporate affiliates (collectively, “VELOGUIDE”), provides an online service that enables individuals to research, locate, and book cycling tours and rentals worldwide. VELOGUIDE offers a variety of cycling tours, tickets and services made available by VELOGUIDE’s third party suppliers through www.VeloGuide.com and its related mobile properties and applications (collectively, the “Website”). The Website is provided to assist customers in gathering travel excursion information, posting opinions of travel excursions, engaging in interactive travel forums, and searching for and booking reservations, and for no other purposes.
1. ACCEPTANCE OF TERMS
By accepting a Booking, Contractor accepts the terms of this Policy. VELOGUIDE reserves the right to update this Policy at any time pursuant to Section 2 herein. The most recent version of this Policy can be reviewed by clicking on the “Booking, Payment & Cancellation Policy” hypertext link located at the bottom of the Website when Contractor is logged in to the Website as a Guide or as a VeloGuide Hub, as applicable.
2. CHANGED TERMS
VELOGUIDE shall have the right at any time to change or modify the terms of this Policy, or to impose new conditions, including, but not limited to, adding or amending fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on the Website, or by electronic or conventional mail, or by any other means by which Contractor obtains notice thereof. Acceptance of any Booking by Contractor after such notice shall be deemed to constitute acceptance by Contractor of such changes, modifications or additions.
Through the Website, User may send a request for a Booking to a Guide by requesting guiding services and / or a rental bicycle for the purposes of participating in a guided bicycle ride on a specified date (herein called the “Guided Ride”) based on the availability of a Guide, and appropriate Equipment availability from a VeloGuide Hub, if required. Once a Guide accepts a User’s request, the Booking is finalized and User’s payment will immediately be processed pursuant to Section 6 herein. Prior to accepting a User’s Booking or Booking amendment request, it is the responsibility of Guide to obtain the VeloGuide Hub’s acceptance of the Booking or amendment, if required.
User, Guide, and VeloGuide Hub will be informed of a Booking by emails respectively sent to their email address by VELOGUIDE. The Guide is subject, upon a accepting a Booking request placed by a User, to complete the Guided Ride as agreed by each party. VeloGuide Hub is subject, upon accepting a Booking request placed by User and relayed by Guide, to provide the Equipment as agreed by each party. The Guide must ensure that the Guide or VeloGuide Hub has sufficient Equipment availability to satisfy the requirements of the Booking. A Contractor who fails to perform a Guided Ride after confirming a Booking may be subject to revocation of their account with VELOGUIDE pursuant to the TOU. After acceptance of a Booking, User may request amendments to the Guided Ride pursuant to Section 6 herein. Contractor is not required to accept a request for amendments to a Booking and will not be penalized by VELOGUIDE for any inability or unwillingness to comply with a Booking amendment request by User.
4. GUIDES & EQUIPMENT
Contractors are independent contractors and not agents or affiliates of VELOGUIDE. VELOGUIDE does not screen or conduct background checks on any Contractor. Guide’s affiliation with or use of the services provided by a VeloGuide Hub is at Guide’s sole risk. VeloGuide Hub’s affiliation with or promotion of the services provided by a Guide, including providing Equipment for use in Guided Rides, is at VeloGuide Hub’s sole risk.
Guides are responsible for working directly with Users on scheduling, meeting time / place, and Guided Ride specifics. VELOGUIDE does not screen or conduct background checks on Users, or make inquiries or representations regarding the physical fitness or technical ability of any User.
Guides are responsible for posting the price of a Guided Ride, inclusive of Equipment rental fees, if applicable (the “Price”). Any Price listed on the Website should be listed per person. If Guide lists a Price on a basis other than per-person basis, Guide should specify the basis for the Price in the description of the Guided Ride.
Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by VELOGUIDE.
Guides may amend the Price without notice, until a Booking has been confirmed. No amendments to the Price are permitted after a Booking has been confirmed.
Unless otherwise specified, the Price does not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax. If any of these fees are included in the Price posted by Guide, Guide should specify that inclusion in the description of the Guided Ride.
Prices are represented to Users as being non-inclusive of tips/gratuities to Guides or VeloGuide Hubs; passport and visa fees; baggage and personal insurance; any items of a personal nature; taxes or duties; and any beverages or food not specifically listed in the Guided Ride description on the Website.
6. PAYMENTS & FEES
When User confirms a Booking through the Website, VELOGUIDE collects User’s payment information and will processes payment for the full Price of the Guided Ride that is the subject of the Booking. VELOGUIDE accepts the following credit cards: Mastercard, Visa, and American Express. There is no charge or service fee for processing credit or debit card payments. Full payment by credit or debit card is required to confirm a Booking. Payment will be listed as www.VeloGuide.com on User’s credit or debit card statement.
VELOGUIDE collects a service fee on each Booking equal to thirty (30%) percent of the Price (the “Service Fee”). VELOGUIDE takes no responsibility for any applicable sales tax, service tax, value added tax, or other fees, charges, levies, or taxation amounts that may be owed to any local or regional governing or taxation authority with respect to any Booking (collectively, “Taxes”). The identification, calculation, and remittance of Taxes owing in connection with any Booking is the responsibility of Guide and / or VeloGuide Hub, as appropriate. Guide should consider the Service Fee and Taxes before posting the Price for a Guided Ride. Through the Website, Guide will indicate to VELOGUIDE what portion of the Price is attributable to Guide and what portion of the Price is attributable to VeloGuide Hub.
After completion of a Guided Ride, the payment made by User pursuant to this Section 6 will be held by VELOGUIDE for a period of five (5) business days, or until Guide confirms that the Guided Ride was performed and not cancelled by any Contractor, whichever shall last occur (the “Clearing Period”). After the Clearing Period, VELOGUIDE will disburse payment to Guide and VeloGuide Hub (if applicable), net of the Service Fee. If User cancels the Guided Ride, cancellation payments to Guide and VeloGuide Hub (if applicable), net of the Service Fee, may be made pursuant to Section 7 herein.
7. CANCELLATIONS & AMENDING A BOOKING
Cancellation of a Booking by User may result in cancellation fees being applied by VELOGUIDE, as outlined below. If a User cancels any Booking, Contractor will be notified via email or telephone of the cancellation and any cancellation fees that may be paid to Contractor. No refunds are available once a Guided Ride has commenced.
- Any Booking cancelled within twenty four (24) hours of the commencement of the cancelled Guided Ride may be eligible for a full refund. If eligible, there will be no cancellation fee, User will be refunded in full and no payment will be made to any Guide or VeloGuide Hub
- Any Booking cancelled within thirty (30) days of the commencement of the cancelled Guided Ride will result in a full refund, there will be no cancellation fee, User will be refunded in full and no payment will be made to any Guide or VeloGuide Hub
- A Booking cancelled fewer than thirty (30) days in advance of the commencement of the cancelled Guided Ride will only result in a full refund if another User books and completes the cancelled Guided Ride.
- Cancellation of a Guided Ride by a Guide or VeloGuide Hub will result in a full refund, and no payment will be made to the Guide or VeloGuide Hub.
- If, at User’s request, Guide or amends the Booking to schedule the Guided Ride to a different time, there will be no cancellation fee.
- If, after confirming a Booking, User requests an amendment to the Booking and Guide or VeloGuide Hub is unable or unwilling to make such amendment, the refund policy described above may apply if the Booking is cancelled a result.
It is VELOGUIDE’S expectation that Guides make every effort to continue, as scheduled, with Guided Rides. Should inclement weather conditions create an unsafe scenario for Users or Guides, a change or partial cancellation of a Guided Ride may result. Should an individual Guided Ride be cancelled by a Guide, VeloGuide Hub, or User, or should a Guided Ride substantially change or terminate early due to inclement weather, VeloGuide will work with Guides and / or VeloGuide Hubs to provide the User with a refund or partial refund that is appropriate in the circumstances.
The value of the transaction may be subject to taxes, duties, foreign transaction, currency exchange or other fees. A bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on the Website, and the final amount charged to User’s bank account or credit or debit card statement. Please advise User to contact the bank or card company if there are any questions concerning any applicable conversion or fees. Please note that in some jurisdictions, certain taxes are not included in the final booking value and will be charged o the credit or debit card used to make the Booking. This may result in a charge amount different than the final booking value, and / or a separate taxation charge.
8. PASSPORTS, VISAS & INSURANCE
It is the sole responsibility of Contractor to obtain valid insurance policies and to ensure that participating in a Guided Ride as a Guide or VeloGuide Hub is covered under the terms of their insurance policy or policies.
