BOOKING, PAYMENT & CANCELLATION POLICY

VELOGUIDE INC., through its parent, subsidiaries and corporate affiliates (collectively, “VELOGUIDE”), provides an online service that enables individuals to research, locate, and book cycling tours and rentals worldwide. VELOGUIDE offers a variety of cycling tours, tickets and services made available by VELOGUIDE’s third party suppliers through www.VeloGuide.com and its related mobile properties and applications (collectively, the “Website”). The Website is provided to assist customers in gathering travel excursion information, posting opinions of travel excursions, engaging in interactive travel forums, and searching for and booking reservations, and for no other purposes.

Through the Website, an individual (a “User”) may register an account with VELOGUIDE (a “User Account”) for the purposes of booking the guiding services of a VELOGUIDE registered guide (a “Guide”), and/or booking bicycles, cycling accessories or other equipment (“Equipment”) for rent through a person or entity offering Equipment for rent (a “VeloGuide Hub”). A booking reservation made by a User on the Website (a “Booking”) is subject to the terms of this Booking, Payment & Cancellation Policy (this “Policy”). User activity on the Website and User Accounts are governed by the terms of VELOGUIDE’s Terms of Use (the “TOU”), which is incorporated into and forms part of this Policy. The most recent version the TOU may be reviewed by clicking on the “Terms of Use” hypertext link located at the bottom of the Website.

  1. ACCEPTANCE OF TERMS

By requesting a Booking, User accepts the terms of this Policy. VELOGUIDE reserves the right to update this Policy at any time pursuant to Section 2 herein. The most recent version of this Policy can be reviewed by clicking on the “Booking, Payment & Cancellation Policy” hypertext link located at the bottom of the Website.

  1. CHANGED TERMS

VELOGUIDE shall have the right at any time to change or modify the terms of this Policy, or to impose new conditions, including, but not limited to, adding or amending fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on the Website, or by electronic or conventional mail, or by any other means by which User obtains notice thereof. The request of any Booking by User after such notice shall be deemed to constitute acceptance by User of such changes, modifications or additions.

  1. BOOKINGS

Through the Website, User may send a request for a Booking to a Guide by proposing requesting guiding services and / or a rental bicycle for the purposes of participating in a guided bicycle ride on a specified date (herein called the "Guided Ride") based on the availability of a Guide, and appropriate Equipment availability from a VeloGuide Hub, if required. Once a Guide accepts a User’s request, the Booking is finalized and User’s payment will immediately be processed pursuant to Section 6 herein. 

User, Guide, and VeloGuide Hub will be informed of a Booking by emails respectively sent to their email address by VELOGUIDE. The Guide is subject, upon a accepting a Booking request placed by a User, to complete the Guided Ride as agreed by each party. The Guide must ensure that the Guide or VeloGuide Hub has sufficient Equipment availability to satisfy the requirements of the Booking. A Guide or VeloGuide Hub who fails to perform a Guided Ride after confirming a Booking may be subject to revocation of their account with VELOGUIDE pursuant to the TOU. After acceptance of a Booking, User may request amendments to the Guided Ride pursuant to Section 6 herein.

  1. GUIDES & EQUIPMENT

Guides and VeloGuide Hubs are independent contractors and not agents or affiliates of VELOGUIDE. VELOGUIDE does not screen or conduct background checks on Guides or on VeloGuide Hubs. User’s use of the services provided by a Guide and / or a VeloGuide Hub, including participating in a guided bicycle ride (a “Guided Ride”) is at User’s sole risk.

A Guide and / or a VeloGuide Hub may require a User to sign a waiver, release or other indemnification agreement as part of the Booking. User hereby agrees to sign any such agreement. Refusal to do so may result in the cancellation of a Booking. Any Booking cancelled as a result of User’s refusal to sign a waiver, release or other indemnification agreement required by a Guide and/or a VeloGuide Hub shall be deemed a cancellation by User and may result in cancellation fees payable by User pursuant to the terms of Section 7 herein.

Users are responsible for working directly with Guides on scheduling, meeting time / place, and Guided Ride specifics. VELOGUIDE makes no representations or warranties of any kind regarding Guides or VeloGuide Hubs and their services. Specifically, VELOGUIDE does not warrant the quality, safety, or level of difficulty of Guided Rides, nor the quality, maintenance, performance, safety or fitness for use of the Equipment.

  1. PRICING

Prices listed on the Website are per person, unless otherwise specified. Guides are responsible for posting the price of a Guided Ride, inclusive of Equipment rental fees, if applicable. Equipment rental fees are ascertained by the Guide, who will communicate directly with VeloGuide Hub to determine cost and availability of Equipment, if applicable.

Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by VELOGUIDE.

Price quotations are subject to change without notice, until a Booking has been confirmed.

Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax.

Prices do not include tips/gratuities to Guides or VeloGuide Hubs; passport and visa fees; baggage and personal insurance; any items of a personal nature; taxes or duties; and any beverages or food not specifically listed in the Guided Ride description on the Website.

  1. PAYMENTS

When User confirms a Booking through the Website, VELOGUIDE collects User’s payment information and will processes payment for the full cost of the Guided Ride that is the subject of the Booking. VELOGUIDE accepts the following credit cards: Mastercard, Visa, and American Express. There is no charge or service fee for processing credit or debit card payments. Full payment by credit or debit card is required to confirm a Booking. Payment will be listed as www.VeloGuide.com on User’s credit or debit card statement.

  1. CANCELLATIONS & AMENDING A BOOKING

Canceling a Booking with VELOGUIDE may result in cancellation fees being applied by VELOGUIDE, as outlined below. When canceling any Booking, User will be notified via email or telephone of the total cancellation fees. No refunds are available once a Guided Ride has commenced.

  • Any Booking cancelled within twenty four (24) hours of the confirmation of the of the Guided Ride may be eligible for a full refund.
  • Any Booking cancelled within thirty (30) days of the commencement of the cancelled Guided Ride will result in a full refund. A Booking cancelled fewer than thirty (30) days in advance of the commencement of the cancelled Guided Ride will only result in a full refund if another User books and completes the cancelled Guided Ride.
  • Cancellation of a Guided Ride by a Guide or VeloGuide Hub will result in a full refund.
  • If, at User’s request, the Guide amends the Booking to schedule the Guided Ride to a different time, there will be no cancellation fee.
  • If, after confirming a Booking, User requests an amendment to the Booking and Guide or VeloGuide Hub is unable or unwilling to make such amendment, the refund policy described above may apply if the Booking is cancelled a result.
  • Any refund issued pursuant to the terms of this Booking, Payment & Cancellation Policy shall be processed within fourteen (14) days of the scheduled commencement of the cancelled Guided Ride.

Guides make every effort to continue, as scheduled, with Guided Rides. Should inclement weather conditions create an unsafe scenario for Users or Guides, a change or partial cancellation of a Guided Ride may result. Should an individual Guided Ride be cancelled by a Guide, VeloGuide Hub, or User, or should a Guided Ride substantially change or terminate early due to inclement weather, VeloGuide will work with your Guide and / or VeloGuide Hub to provide a refund or partial refund that is appropriate in the circumstances.

The value of the transaction may be subject to taxes, duties, foreign transaction, currency exchange or other fees. A bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on the Website, and the final amount charged to User’s bank account or credit or debit card statement. Please contact the bank or card company if there are any questions concerning any applicable conversion or fees. Please note that in some jurisdictions, certain taxes are not included in the final booking value and will be charged o the credit or debit card used to make the Booking. This may result in a charge amount different than the final booking value, and / or a separate taxation charge.

  1. PASSPORTS, VISAS & INSURANCE

When booking international reservations with Guides and/or VeloGuide Hubs using the Website, User is responsible for ensuring that User meets all foreign entry requirements and that all travel documents, including passports and visas, are in order.

For passport and visa requirements, please consult the relevant embassy or consulate for information. Because requirements may change at any time, be sure to check for up-to-date information before booking and departure. VELOGUIDE accepts no liability for travelers who are refused entry onto a flight or into any country because of the traveler's failure to carry the travel documents required by any airline, authority, or country, including countries the traveler may just be passing through en route to his or her destination. If such refusal results in a Booking cancellation, the terms of Section 7 herein shall apply.

As visa and health requirements are subject to change without notice, VELOGUIDE recommends that User verifies health and visa requirements with the appropriate consulate prior to departure. It is User’s responsibility to consult a physician for current recommendations on inoculations before international travel, and to ensure that all health entry requirements are met, and follow all medical guidance related to any trip.

We strongly recommend that User purchases a comprehensive travel insurance policy prior to departure to protect any Booking. If a trip is cancelled or travel dates are significantly altered, a travel insurance policy may reimburse the cost of cancellation fees and related expenses. Please review any travel insurance policy carefully for related terms and conditions.

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. VELOGUIDE urges Users to investigate and review travel prohibitions, warnings, announcements and advisories issued by the Canadian Government and destination country governments prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at https://travel.gc.ca/travelling/advisories.

By listing information relevant to travel to particular international destinations, VELOGUIDE does not represent or warrant that travel to such points is advisable or without risk, and is not liable for damages or losses that may result from travel to such destinations.
